PODOLSKA 21 – for the purposes of this Privacy Policy, PODOLSKA 21 means Fprop Gdynia Sp. z o.o.

Controller – PODOLSKA 21 acts as an independent Controller of personal data processed as part of its business activities. The list in item 2 below indicates the Controller of personal data processed within the activities carried out by PODOLSKA 21.

If you contact us or we contact you in matters other than:

  • the lease of office space offered by PODOLSKA 21, or
  • cooperation with us as our contractor,

then your personal data will be processed by PODOLSKA 21 solely for the purpose of handling the matter related to that specific contact.

Legal bases for processing your personal data

The legal basis for processing your personal data is our legitimate interest (Article 6(1)(f) GDPR) consisting in handling incoming correspondence and dealing with ongoing matters related to our business activities. We process your data only if you have provided it yourself or it has been provided by your employer / the entity you represent. Providing your data is voluntary; however, without it we will not be technically able to contact you and handle the matter you have raised.

Data retention period

Your personal data will be processed for the duration of the communication and correspondence. After this period, the data may be processed until the limitation period for potential claims. The data may be deleted earlier if an effective objection to their processing is lodged.

Data recipients

We will share personal data with Fprop Gdynia Sp. z o.o. for administrative purposes and, otherwise, only with entities we cooperate with in conducting our business.

5. Handling contact with prospective clients

Purposes of processing your personal data

If you contact us regarding the lease of the office space we offer, your personal data will be processed in order to respond to your questions, present our offer, and maintain ongoing contact on matters related to the conclusion of a potential agreement.

Legal bases for processing your personal data

The legal basis for processing your personal data will be taking steps necessary to enter into a contract (Article 6(1)(b) GDPR). We process the data if you provide it to us. Providing personal data is voluntary; however, we only collect the data we need, which means that without it we will not be technically able to contact you or prepare an offer, agreement, etc.

Data retention period

Personal data provided to us will be processed for the duration of the ongoing communication during talks and negotiations. If no agreement with PODOLSKA 21 is concluded, personal data may be processed until the limitation period for potential claims.

Data recipients

We will share personal data with Fprop Gdynia Sp. z o.o. for administrative purposes and, otherwise, only with entities we cooperate with in conducting our business.

6. Handling contact with (prospective) contractors

Purposes of processing your personal data

If you are our (prospective) contractor, your personal data will be processed so that we can communicate on current matters, in particular to respond to inquiries, receive and present offers, conduct negotiations, and conclude and perform agreements.

Legal bases for processing personal data

Where you are our prospective contractor, the legal basis for processing personal data is taking steps to enter into a contract or its performance (Article 6(1)(b) GDPR).

Source of personal data

  • You provided your personal data to us yourself; or
  • the data was made available in a publicly accessible source, in particular on a website.

When data is obtained from a publicly available source, we process it for the purpose of contacting you and do not process more data than: first name, last name, position, represented entity, phone number, and e-mail address. If we take steps to enter into a contract, we additionally process your data necessary for a future agreement, e.g. business address, correspondence address, NIP (Tax ID) number, REGON number. Providing personal data is voluntary; however, we only collect the data we need, which means that without it we will not be technically able to contact you or conclude a contract.

Data retention period

Your personal data will be processed for the duration of our ongoing communication and cooperation. After cooperation ends, the data may be processed until the limitation period for potential claims.

7. Monitoring and access control in our building

Purposes of processing your personal data

To ensure the safety of people and property, to maintain order on the premises, and to enable the pursuit or defence of potential claims, our building may be equipped with monitoring and/or access control. Personal data collected through monitoring and/or access control is not used for any other purposes. If a given building is equipped with monitoring, we always inform you of this before entering the building or the monitored area.

Legal bases for processing your personal data

The legal basis for processing your personal data is our legitimate interest and that of the building’s guests and tenants (Article 6(1)(f) GDPR), consisting in the need to ensure the security of property and persons in our facilities and to protect our rights as the building owner against potential claims of third parties. We will process your data only if you enter areas covered by monitoring or if you provide the data necessary to obtain access cards. Providing your data is voluntary but necessary — if you do not want your data to be collected, unfortunately you will not be able to enter areas covered by monitoring and access control.

Data retention period

Personal data collected through monitoring is stored for 7 days, and data collected within access control for 30 days. If securing monitoring recordings or information collected by the access control system is necessary to establish, pursue, or defend claims, personal data will be processed until the limitation period for potential claims. The data may be deleted earlier if an effective objection to their processing is lodged.

Data recipients

We will share personal data with Fprop Gdynia Sp. z o.o. for administrative purposes and, otherwise, only with entities we cooperate with for the protection as well as administrative and technical operation of the buildings, including the building manager, the security provider, and the monitoring and data transmission (hosting) provider. Apart from these cases, personal data processed within monitoring and/or access control may be disclosed to authorised authorities where an obligation to disclose arises from law.

8. Conducting recruitment processes

Purposes of processing your personal data

If you intend to apply for a job with us, please note that it is sufficient for us that you provide the data specified in labour law regulations. If you provide other data not required by us, we will consider that you consent to its processing. You may withdraw your consent at any time; this does not affect the lawfulness of processing based on consent before its withdrawal.

As part of recruitment, we process personal data to assess qualifications and experience for the position applied for, to contact the candidate to arrange meetings, conduct interviews, negotiate the terms of a future agreement, and to take a potential employment decision. If you consent when submitting your application, your data may also be processed by us for future recruitment processes until consent is withdrawn.

Legal bases for processing your personal data

  • for the scope of data listed in Article 221 of the Labour Code, on the basis of a legal obligation incumbent on us as the controller (Article 6(1)(c) GDPR in conjunction with Article 221 of the Labour Code);
  • for data not required by law and for the purpose of considering your candidacy in future recruitment processes, on the basis of consent (Article 6(1)(a) GDPR);

Personal data provided to PODOLSKA 21 may also be processed on the basis of our legitimate interest (Article 6(1)(f) GDPR), consisting in:

  • pursuing potential claims or defending against such claims;
  • processing personal data provided by you during the interview in order to verify your qualifications and skills for the position applied for.

Data retention period

Your personal data will be processed until the recruitment process is completed. For data processed by us on the basis of legitimate interest, the data may be deleted earlier if an effective objection to their processing is lodged. If you have consented to the processing of personal data for recruitment we conduct in the future or to the processing of data to a wider extent than required, the data may be processed until consent is withdrawn.

We will share personal data with Fprop Gdynia Sp. z o.o. for administrative purposes and, otherwise, only with entities we cooperate with in recruitment. Apart from these cases, personal data processed within monitoring and/or access control may be disclosed to authorised authorities where an obligation to disclose arises from law.

9. Other types of data processed by PODOLSKA 21

Processing personal data for contract performance

Personal data will also be processed if you decide to conclude an agreement with us. Before collecting data for the conclusion of an agreement, we provide detailed information on the processing of personal data, regardless of whether you conclude the agreement as our client, contractor, or employee.

Processing data for marketing purposes

Personal data may be used for marketing purposes only after obtaining your separate consent. Without such consent, you will not receive commercial information from us that you have not requested yourself. Before you consent to receiving marketing information, we inform you in detail how, for what purposes, and on what legal bases your personal data will be processed.

Processing personal data in other cases

In connection with our business activities, we also collect and process data in other cases, for purposes related to initiating and maintaining business contacts, e.g. during business meetings or through the exchange of business cards, etc. The legal basis for processing data in such situations is our legitimate interest (Article 6(1)(f) GDPR) consisting in creating and maintaining relationships with our clients, contractors, and associates.

Personal data collected in such cases is processed solely for the purpose for which it was provided to us and is not disclosed to any other persons except for entities we cooperate with in running our business (service providers), in particular hosting providers, etc. Your personal data collected in such cases will be stored for the duration of our relationship justifying mutual contact for cooperation purposes or until you object to the processing of your data.

Rights related to the processing of your personal data

In connection with our processing of your personal data, you have the following rights:

Right of access

You may obtain information about our processing of your personal data, including in particular the purposes and legal bases of processing, the types (categories) of data, the recipients to whom we disclose data, and the planned retention period.

Right to obtain a copy of your personal data

Upon request, you will receive a copy of the data we process.

Right to rectification

If the data we process is incorrect or incomplete, you may ask us at any time to correct or complete it.

Right to erasure

You may request the deletion of personal data we process where it is no longer necessary for any of the purposes for which it was collected.

Right to restriction of processing

If you request restriction, your personal data will no longer be processed other than for storage until the reasons for the restriction cease. Apart from storage, during the restriction period, personal data may be processed exceptionally on the basis of consent or for the establishment, exercise, or defence of legal claims, or for the protection of the rights of another natural or legal person, or for important reasons of public interest.

Right to data portability

If we process data in connection with a contract or on the basis of consent, you may ask us to provide your personal data, which you have provided to us, in a machine-readable format. You may also request that this data be transmitted to another entity, provided this is technically feasible both on our side and on the side of the entity to which you wish your data to be transferred.

Right to object to processing

For data processed on the basis of our legitimate interest (this basis is indicated in Article 6(1)(f) GDPR), you may object to its processing at any time. An objection to processing should include reasons, except that you may object to processing for direct marketing purposes without providing reasons.

Right to withdraw consent

Where we process your data on the basis of consent (the basis indicated in Article 6(1)(a) GDPR), you may withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Right to lodge a complaint with the supervisory authority

If you believe that our processing of your personal data violates the GDPR or other data protection regulations, you have the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO).

You will receive a response to your request via the same channel you used to submit it, unless you clearly indicate the form in which you wish to receive it. A request to exercise your rights is handled within one month of receipt. This period may be extended if necessary; in such a case you will be informed of the extension and the reasons for it.
